Great American Insurance Co. (Great American) filed an action for declaratory relief and contribution against Aetna Casualty and Surety Co. (Aetna) in the United States District Court for the District of Hawaii, claiming that Aetna was required to contribute defense costs paid by Great American on behalf of a mutual insured, Mitsui & Co., Inc. (Mitsui). Aetna contended that it was not required to contribute defense costs incurred prior to its receiving notice of the underlying lawsuit against Mitsui. Both parties moved for summary judgment.
